The Information We Collect
“Personal information” includes any information that identifies, relates to, references, or is reasonably capable of being associated with or linked to a particular individual. It does not include publicly available information from government records or information that has been deidentified or aggregated.
The types of personal information we may collect and process about you can be grouped as follows:
- Identity information – first name, last name, username and password for website account.
- Contact information – shipping address, email address, and telephone number.
- Financial data – payment card details and payment information.
- Transactional data – details about orders you have placed, inquiries you have made (including customer service inquiries), and payments received from you.
- Marketing and communications information – details regarding requests for information received from you, marketing campaigns with which you have interacted, promotions you have participated in, and information on your marketing or communication preferences.
- Contest and survey information – details regarding contests, sweepstakes, or surveys you participated in or survey responses you provided.
It is typically your choice whether you wish to provide personal information to us directly through this Site; however, if you do not provide requested personal information, you may not be able to use certain features or functionalities of the Site.
How We Collect, Use, and Share Your Information
We may collect personal information (for example, your full name, email address, mailing address, telephone number, or credit card number) directly from you when you voluntarily submit the information to us when you use our Site, communicate with us, or purchase goods from us. These partners may also combine your email information with other information they have access to such as mailing address so that we may serve relevant marketing offers to you via email and direct mail. When Blu Dot conducts contests, sweepstakes, promotions and surveys, or joins with other companies to do so, if you choose to participate you may be asked to provide personal information. Blu Dot and the other participating companies may use this information for such purposes as notifying winners and fulfilling promotional obligations, and may also cross reference customer databases to identify common customers. Information from these activities may be used to explore future promotional opportunities or fulfill contractual obligations. Even if you have chosen not to receive communications from Blu Dot prior to your participation in a contest, sweepstakes, promotion or survey, you may still receive information from Blu Dot in connection with such activity if you register for or participate in such activity. You may choose not to participate in contests, sweepstakes, promotions or surveys if you do not wish to receive information from Blu Dot or share your information with Blu Dot and the other companies sponsoring such activities.
We may also use your information to contact you about goods and services that may be of interest to you. We may also share your information with unaffiliated third parties for promotional purposes, including the marketing of their products or services provided that you have not opted out of these disclosures. Choices for Opt-in and Opt-out
We may use the services of third parties to collect and use anonymous information about your visits to and interactions with our Site through the use of technologies such as Cookies to personalize advertisements for goods and services. Please note that if you opt-out as described above, we will not remove your personal information from the databases of our third-party marketing partners or other third parties with which we have already shared your personal information as of the date that we implement your opt-out request, unless legally required to do so. Please also note that if you do opt-out of receiving marketing-related messages from us, we may still send important administrative messages to you, and you cannot opt-out from receiving such administrative messages. For example, when you place an order, we will continue to confirm your order and shipment status by email. Deidentified and Aggregated Information
We and our service providers may deidentify and/or aggregate personal information collected so that it is no longer capable of identifying or being linked to you. For example, we may use personal information to calculate the percentage of individuals who have a particular telephone area code. Such deidentified or aggregated personal information is not personal information. Rather, it is an asset belonging to us and, as such, we may use it for any purposes consistent with applicable law.
We use reasonable efforts to protect our customers’ information. For example, when our registration/order form asks customers to enter sensitive information (such as credit card number), that information is encrypted and is protected using Secure Socket Layer (SSL) technology.
The safety and security of your information, however, also depends on you. Where we have given you (or where you have chosen) a password for accessing the Site, you are responsible for keeping such password confidential and should not share it with third parties. If you are sharing information in public areas on our Site, like message boards, we urge you to be careful about the type of information you provide as it may be viewed by any user of the Site.
The transmission of information via the Internet is not completely secure. Our Site is a general audience website and is not directed at, or intended for use by, individuals under 16 years of age. No one under age 16 may provide any information to or on the Site. In the event we inadvertently receive personal information from an individual under 16, we will promptly delete the information upon becoming aware of its collection. California Privacy Rights Under the California Consumer Privacy Act (CCPA)
Rights: The CCPA provides California residents with the following rights relating to their personal information, subject to certain exceptions:
- Right to Know. You have the right to request that we disclose certain information about our collection and use of your personal information during the past 12 months. Specifically, you may request that we disclose:
- The categories of personal information we collected about you;
- The categories of sources for the personal information we collected about you;
- The business and commercial purposes for collecting your personal information;
- The categories of third parties with whom we shared your personal information;
- The specific pieces of personal information we collected about you; and
- If we disclosed your personal information for a business purpose, the categories of personal information received by each category of third party.
To exercise the rights described above, you—or someone authorized to act on your behalf—must submit a verifiable consumer request to us by calling us at 844.425.8368, submitting a request online at bludot.com/contact-us, or [email protected] Your request must allow us to reasonably verify that you are the individual regarding whom we collected the personal information and must describe the request with enough detail that we can understand and respond to it. You may only submit requests for access or data portability twice within any 12-month period. As indicated above, please be aware that the CCPA provides certain limitations and exception to the foregoing rights, which may result in us denying or limiting our response to your request.
The CCPA requires us to respond to a verifiable consumer request within 45 days, but permits us to extend that period by an additional 45 days, provided we notify you of the reason for the extension in writing. We will notify you that we have received your request within 10 days of its receipt and we may request additional information from you if we are not able to verify your request. In general, we will not charge a fee to respond to a verifiable request, unless it is excessive, repetitive, or unfounded.
Categories and Sources of Personal Information: In the past 12 months, we have collected the following categories of personal information from California residents through our Site:
- Personal information categories in California’s Consumer Records statute; examples include name, address, telephone number, credit or debit card numbers.
- Identifiers; examples include name, alias, postal address, unique personal identifiers, IP address, other online identifier, email address.
- Internet or similar network activity; examples include information relating to your interaction with our Site, browsing history, search history.
As discussed in more detail above in “How We Collect, Use, and Share Your Information,” we collect this information from you when you provide it to us by filling out forms on our Site, registering to receive emails or information from us, creating an online account, communicating with us using chat features, and placing an order with Blu Dot. We also collect certain identifiers (such as IP addresses) and Internet and similar network activity (such as website usage data) from you indirectly when you visit, use, and navigate across our Site. We also collect personal information from our third-party marketing and analytics service providers. We may work with those service providers to make inferences based on other personal information that is available to them in order to provide marketing materials to prospective customers.
Business and Commercial Purposes for Collecting: The business and commercial purposes for which we collect personal information are described above in “How We Collect, Use, and Share Your Information.”
Disclosure and Sale of Personal Information: Third parties with whom we may disclose your information include: (1) service providers, but only as necessary for us to conduct business and provide the agreed-upon services to you or related services; and (2) governmental agencies, as may be required by law.
During the past 12 months, Blu Dot has disclosed the following categories of personal information for a business purpose: personal information categories in California’s Consumer Records statute, identifiers, internet or similar network activity. This information was disclosed to service providers.
Blu Dot sold a small amount of personal information in the last 12 months to a catalog marketing partner, but we have discontinued all sales and have no future plans to sell personal information to third parties.
California’s “Shine the Light” Law Disclosure
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of personal information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year.
